Ask An Attorney: Can CBDA And CBGA Be Marketed As A COVID Treatment?

With the continuing threat of new SARS-CoV-2 (COVID-19) variants looming on the horizon, scientists have been relentless in searching for a long-term solution to the ever-present pandemic that has affected the lives of millions around the world. In a promising turn of events, new studies indicate that certain natural compounds found in a familiar plant may be key to halting COVID-19 in its tracks. These dark horse candidates are cannabigerolic acid (CBGA) and cannabidiolic acid (CBDA)—common compounds found in hemp.
The important question here is whether businesses can legally market and sell these CBGA and CBDA products to defend against COVID-19.The short answer is likely no, or at least not yet. But the answer, like many others impacting the hemp space, is layered and requires an understanding of how the federal and state laws in play impact these cannabinoids and the new studies.
